Terms and Conditions

These General Terms and Conditions regulate the use of the website www.newgarden.es, property of NEWGARDEN SPAIN, S.L., with address at Avda. Francia, 5 – 15. Pol. Ind. Las Salinas de Alhama, 30840, Alhama de Murcia (MURCIA), e-mail [email protected] and telephone 968978886 with CIF B98434665, and registered in the Mercantile Register of Murcia, volume 1879, folio 1, registration page MU-40290.

 

Any order placed on www.newgarden.es necessarily implies, as an essential, determining and indispensable condition, the unreserved acceptance by the Client of the General Conditions of Use in force on the day on which the corresponding order is placed. Furthermore, the Customer acknowledges that acceptance of the present conditions shall imply their application to the order to which they refer, as well as to any subsequent order, with the exception of those cases in which new conditions are brought to the Customer’s attention.

 

Users

In order to purchase any of the products shown on www.newgarden.es, the user must be legally entitled to do so in accordance with Spanish law.

There are two types of users, end consumers and professionals. If you are a professional, this will be specified at the time of registration by accessing the link for distributors.

These terms of use are addressed to the end consumer purchasing products on www.newgarden.es.

Purchasing Procedure

Choose: choose the desired product, click on it, and you will see a detailed description of it, once chosen you can choose from the different options we provide. From the product itself you can add it to the shopping basket.

Purchase: once in the shopping cart, you will have to follow the steps established for the confirmation of the purchase and provide the required data.

Confirmation: once you have logged in, the only thing left to do is to confirm the order.

Upon completion of your order, you will be sent an email confirming receipt of your order, specifying all the details of the order. If you notice an error in the address indicated or in any other part of the order, you must notify [email protected] immediately in order to correct the error.

 

Prices

The prices published on www.newgarden.es are in Euros and are valid unless there is a typographical error.

Through the website www.newgarden.es, you can consult the current rates excluding VAT, unless otherwise indicated. Taxes can be consulted in the shopping cart.

 

Payment Methods

Payment shall be made by any of the following means:

Transfer: If you choose to pay by bank transfer at the end of the purchase process will specify the account number to which the transfer should be made as well as a reference number that must be specified at the time of making the transfer. Once your payment has been confirmed, we will proceed to ship your order.

Credit or debit card purchases: the user must provide the cardholder’s name, card number, expiry date and CVV. All information will be processed through the bank’s POS.

Shipping

The purchased products will be delivered to the person and at the address indicated in the order within the maximum ESTIMATED DELIVERY TIME.

Shipping costs will be specified at the time of purchase.

 

RECALL OF THE USED ELECTRONIC PRODUCT WITH THE SAME CHARACTERISTICS AS PURCHASED
Newgarden provides the customer with the possibility to pick up a used electronic product with the same characteristics as the one sold.

Right of withdrawal

The user may revoke the purchase or withdraw from the contract within 14 calendar days without giving any reason. The withdrawal period will expire 14 calendar days after you or a third party indicated by you, other than the carrier, acquired material possession of the goods.

In order to exercise the right of withdrawal, you must notify us of your decision to withdraw from the contract by means of an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You also have the option of completing and sending us the model withdrawal form or any other unequivocal statement via [email protected]. If you make use of this option, we will inform you without delay, on a durable medium, of the receipt of such withdrawal.

If the reason for the return is that the returned item is defective or does not correspond to what was requested in the order, NEWGARDEN SPAIN, S.L. will bear the cost of the return and reshipment.

If the reason for the return is that the order does not satisfy you:

  • We will refund the amount including delivery costs (except delivery costs if you have chosen an option other than ordinary delivery, in which case only the costs allocated by the website for ordinary delivery will be refunded) without undue delay.
  • The refund shall be made no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract.
  • You will have to bear the direct cost of returning the goods, valued at 15 euros.
  • The refund will be made using the same means of payment that was used for the initial transaction, unless you have expressly agreed otherwise, and provided that no additional charges are incurred.
  • The company reserves the right to withhold reimbursement until it has received the goods, or until you have provided proof of return of the goods, whichever condition is met first.
  • If you are not satisfied with the product for reasons other than defects or faults in the delivery, the customer will be responsible for the shipping and the cost of delivery.

EXCLUSION: The right of withdrawal shall NOT apply to personalised Products (colour or lighting finish), custom-made products, reconditioned products, Products made to the Customer’s specifications or which have been the subject of a special order.

Guarantee

All our products have at least a two-year legal guarantee, for which NEWGARDEN SPAIN, S.L., as the seller of the product, is responsible under the legally established terms.

Similarly, manufacturers offer a commercial guarantee which, on occasions, can improve the terms and conditions of the legal guarantee. It is therefore very important that you read the warranty conditions of each product, and keep the proof of purchase, as they will be necessary for you to benefit from the warranty.

Defects caused by negligence, knocks, improper use or manipulation, unsuitable voltage, incorrect installation not carried out by the authorised Technical Service when applicable, or materials subject to wear and tear due to normal use are not included.

In those incidents that justify the use of the warranty, we will opt for the repair, replacement of the article, discount or refund, in the legally established terms.

Applicable Law and Forum

This purchase system is subject to the legislation in force in Spain (Civil Code, Commercial Code, Law 7/1996, of 15 January, on the regulation of retail trade, Law 7/1998, on General Conditions of Contract, Law 26/1984, General Law for the Defence of Consumers and Users, Royal Decree 1906/1999, of 17 December, on telephone and electronic contracting with general conditions and Law 34/2002, on Information Society Services and Electronic Commerce).

In accordance with Law 34/2002 of 11 July 2002, the contract shall be presumed to have been concluded at the seller’s address (Spain). In the event of any disagreement that may arise as a result of this contractual relationship and which cannot be resolved amicably, it will be submitted to the Courts that are considered competent in each case.

In any case, the user shall have the possibility to settle the dispute online at https://webgate.ec.europa.eu/odr.
